Google Submits Concessions to EC; Gets Sued in the UK

Google has finally submitted a formal concession offer to the European Commission, which is now going to test-market them with complainants and competitors such as Microsoft. Google could emerge from the two-year antitrust investigation of its search practices without paying a fine. Reuters says Google has offered to label its own services in search results to differentiate them from rival services and to impose fewer restrictions on advertisers. EC Antitrust chief Joaquin Almunia says he wants "legally binding commitments" from Google. Google, meanwhile, has been sued in London's High Court of Justice, Chancery Division by a UK company called Streetmap for "cynical manipulation of [its] search results" to favor Google Maps and make it hard to find its rivals, exactly the kind of charges the EC has been investigating. Cook, Schmidt, Otellini Ordered into Court

District Court Judge Lucy Koh has ordered the CEOs of Apple, Intel and Google to show up in her courtroom, each of them to answer four hours of questions about their deal not to poach each other's people. A civil suit brought by workers who figure they got shortchanged in the process could turn into a class action that could cost the companies hundreds of millions of dollars since Steve Jobs, Eric Schmidt and Paul Otellini were silly enough to trade e-mails about the arrangement. AllThingsD obtained an e-mail from Google HR that reads, "Google has an agreement with Apple that we will not cold call their staff." There's also an e-mail from Steve Jobs to then Google CEO and Apple board member Eric Schmidt asking that Google kindly stop reaching out to Apple employees. Cloud Economics: Microsoft, Google & Amazon

Sridhar Vembu's blog Yesterday Microsoft launched its Azure cloud platform, so it is time for another spreadsheet. To properly compare Microsoft, Google and Amazon, I am using the gross profit (instead of revenue) and net profit numbers. Gross profit is, in some sense, the real revenue of a company after paying its outside suppliers; gross profit is what is available to pay its employees, pay the rent, and so on. For a software company, the cost of goods sold is close to zero, so most of the revenue is gross profit. But for a retailer, as much as 70-80% of revenue goes to its suppliers, so gross profit is the better measure of the economic productivity the company achieves. Canonical Aims Koala at Amazon Cloud

Last Friday Canonical founder Mark Shuttleworth dubbed the next turn of Ubuntu “Karmic Koala,” the future Ubuntu 9.10 due in October, and immediately pointed its server side to the cloud. “Ubuntu,” he said on a blog, “aims to keep free software at the forefront of cloud computing by embracing the APIs of Amazon EC2, and making it easy for anybody to setup their own cloud using entirely open tools. We’re currently in beta with official Ubuntu base AMIs [Amazon Machine Images] for use on Amazon EC2. During the Karmic cycle we want to make it easy to deploy applications into the cloud, with ready-to-run appliances or by quickly assembling a custom image. [Update] Swiss Bank Closes Assange’s Account

PostFinance, the Swiss Post Office bank, has closed the account that WikiLeaks boss Julian Assange opened after PayPal late Friday closed the one the renegade site has been using to collect donations. The Swiss Post bank said Monday morning that it found "Assange provided false information regarding his place of residence when opening the account." The statement on the bank's web site adds that "The Australian citizen provided false information regarding his place of residence during the account opening process. Assange entered Geneva as his domicile. Upon inspection, this information was found to be incorrect. Assange cannot provide proof of residence in Switzerland and thus does not meet the criteria for a customer relationship with PostFinance. Okta Seeks to Accelerate Secure Adoption of Cloud Apps

"Enterprises everywhere are realizing the inherent benefits of running their core IT services in the cloud,” said Todd McKinnon, most recently VP of Engineering at Salesforce.com from 2003 to 2009, and now CEO of the on-demand identity and access management service, Okta. "This shift fundamentally requires them to rethink their IT infrastructure and how their employees access it," McKinnon added.
