Motorola Mobility and its puppet master Google are going to try to get the iPhone 4S and iCloud enjoined in the United States.
The pair moved on the very day that Apple hit the ball so far out of the park they’re still looking for it after it announced it sold a record 37 million iPhones last quarter, described iCloud as the “strategy for the next decade, not a product,” and was lauded as the most valuable property on earth.
They’re charging the Apple widgetry with infringing six MMI patents that were asserted against older Apple products in the same district court in Florida in 2010.
It was too late to add the iPhone 4S and the iCloud to the original suit so MMI filed a new suit Tuesday. According to patent watcher Florian Mueller that means Google, MMI’s prospective new owner, had to approve. (It’s in their merger agreement.)
Florian thinks it’s “not the same kind of aggressive escalation as a lawsuit over a new set of patents would have been,” but he reckons it means something that Google signed off on another lawsuit “at this stage – as opposed to waiting for its purchase of MMI to close.”
He suspects Google will ratchet up the patent attacks if and when the regulators let it take over MMI.
The January 24th suit asserts six patents against the 4S and two against iCloud. Apple is accused of infringing patents on a receiver having concealed external antenna; a multiple pager status synchronization system and method; a method and apparatus for communicating summarized data; a system for communicating user-selected criteria filter prepared at wireless client to communication server for filtering data transferred from host to said wireless client; an apparatus for controlling utilization of software added to a portable communication device; and a method and apparatus in a wireless messaging system for facilitating an exchange of address information.
